By accessing or using the Alby platform ("Service") operated by LS Global Group ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you also agree to our Privacy Policy.

Alby is a multi-channel outreach platform that enables businesses to manage sales communications across email, calling, SMS, LinkedIn, social media, and AI avatar agents. The Service includes campaign management, contact management, analytics, and automated outreach capabilities.

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal authority to bind yourself or your organization to these Terms.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Send unsolicited messages (spam) or messages to individuals who have not consented to receive them
• Transmit harmful, threatening, abusive, or otherwise objectionable content
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any purpose that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or similar messaging regulations

By opting in to receive SMS messages from LS Global Group (Alby), you consent to receive recurring automated text messages related to sales outreach, appointment scheduling, and service notifications.

Carriers are not liable for delayed or undelivered messages.

The Service and its original content, features, and functionality are and will remain the exclusive property of LS Global Group and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

You retain all rights to any content you submit, post, or display through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display such content solely for the purpose of providing the Service.

In no event shall LS Global Group, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

We do not guarantee the delivery, timeliness, or accuracy of SMS messages or other communications sent through the Service. Wireless carriers and other third-party providers are not responsible for delayed or undelivered messages. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and disclose your information. Please review the Privacy Policy carefully. By using the Service, you consent to the practices described therein.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Broward County, Florida.
